Descricão e Informacões Adicionais	A análise do Direito Internacional dos Refugiados, sua formação histórica, desenvolvimento normativo e institucional permeia-se no que se denomina de Direito das Gentes. Seu caráter evolutivo perpassa pelo contexto da guerra e da paz, da escravidão e da liberdade, assim como se reveste de elementos de solidariedade, inerentes às relações jurídicas firmadas entre os Estados e as Organizações Internacionais, enquanto sujeitos de Direito Internacional. A teoria clássica do Direito Internacional, autônoma e sistematizada, permeia-se de elementos basilares a partir do final do século XVII, inseridos nos tratados de Münster e Osnabrück, conhecidos como Tratados de Paz de Westfália. Refletir sobre o desenvolvimento jurídico desde a Segunda Guerra Mundial, os desafios enfrentados ao longo dos séculos, como responder às crises de refugiados em todo o mundo, e recuperar a esperança de refugiados, apátridas e outras pessoas que foram forçadas a deixar o lugar onde moravam. Analisar estas questões, assim como a contribuição do Brasil ao receber várias dessas pessoas são delineamentos de política internacional e solidariedade contidos neste trabalho.
Descricão e Informacões Adicionais(en)	The analysis of the International Law of the Refugees, its historical background, institutional and juridical development entangles itself in the Law of the Peoples. Its developed character enters into the context of war and peace, slavery and freedom, as well as the elements of solidarity, linked to the juridical relations signed among States and the International Organizations, as subjects of the International Law. The International Law classical theory is autonomous and systemic regulated, rich in basic elements dated of the end of the XVIIth century, inserted into the Münster and Osnabrück treaties, known as Westphalia Peace Treaty. To reflect on the juridical development since the II World War, the challenges faced throughout the centuries, how to answer to the refugees crises in the entire world, to recover the refugees hope, and the hope of citizens without a country, and the situation of other people forced to leave their countries, as well as the Brazilian diplomatic contribution on accepting some refugees are issues pointed out in this research paper.
