| Descricão e Informacões Adicionais | Na história recente se verifica como os direitos humanos se converteram em um interesse internacional, capaz de ultrapassar a barreira do Estado fechado em si mesmo, fazendo com que a legislação tratados e decisões internacionais repercutissem internamente. Nesta perspectiva é que abordaremos o Tema Regularização de Territórios Quilombolas, regulamentado pelo Decreto 4.887/2003, que por sua vez dá efetividade ao Artigo 68 do Ato das Disposições Constitucionais Transitórias ADCT. Em face de tal decreto, o então Partido da Frente Liberal PFL, hoje Democratas DEM, interpôs Ação Direta de Inconstitucionalidade ADI 3239/DF, no Supremo Tribunal Federal STF, ainda em fase de julgamento, contudo, já se vê nesse tema e em especial no voto vista da Ministra Rosa Weber como é oportuna a consulta e uso da jurisprudência internacional, especialmente por ser o Brasil Estado-Membro do Pacto Internacional invocado. |
| Descricão e Informacões Adicionais(en) | In recent history it appears as human rights became an international interest, able to overcome the state`s barrier closed in on itself, causing the legislation - treaties - and international decisions reverberate internally. In this perspective it is that we will approach the theme - Regularization of Quilombola Territories, regulated by Decree 4.887 / 2003, which in turn gives effect to the Article 68 of the Constitutional Provisions - ADCT. In the face of such a decree, the then Liberal Front Party - PFL, now Democrats - DEM, filed direct action of unconstitutionality - ADI 3239 / DF, the Federal Supreme Court - STF, still undergoing trial, however, already see this theme and especially in the vote of the Minister Rosa Weber as timely consultation and use of international jurisprudence, especially because Brazil Member State of the International Covenant invoked. |
