Descricão e Informacões Adicionais | O objetivo deste trabalho é analisar a hermenêutica na contemporaneidade, sua importância e interpretação ordenada, no âmbito da ciência jurídica. A evolução histórica do estudo da hermenêutica mostra sua importância a partir da Revolução Francesa e da publicação do Código Civil de Napoleão. Fatos históricos evidenciam as reivindicações do povo em face de uma nova consciência, em prol de um pensamento igualitário, ou seja, as pessoas deveriam ser iguais perante a lei e, todas as coisas, deveriam partir da vontade comum. A verdade sobressai-se tanto no meio politico, jurídico e teológico, tendo o amparo da Filosofia. A hermenêutica aponta que o Direito necessita de uma área do conhecimento específica para estudar e interpretar suas leis, tendo como propósito fazer com que o aplicador do direito compreenda não apenas o sentido empregado pelo legislador, mas também a essência que a lei transmite, abarcando os costumes e o juízo de valor |
Descricão e Informacões Adicionais(en) | This paper aims at analyzing the contemporary hermeneutics, its importance and its interpretation arranged in a systematic way, as part of the juridical science. Historical evolution of the study of hermeneutics points out its importance beginning with the French Revolution and the publication of the Napoleon Civil Code. Historical facts highlight peoples vindication due to a new knowledge, aiming at an egalitarian thought; that is, everybody should be equal before Law, and all things should have a starting point based on the common wish. The truth projects itself in the political, juridical and theological environment, supported by Philosophy.
