| Descricão e Informacões Adicionais | Resumo: No presente artigo, estudam-se o conceito e as origens da plea bargaining, em especial nos Estados Unidos. Para tanto, primeiro, aborda-se o conceito da plea bargaining e suas diversas modalidades, explicando brevemente em que consistem os institutos do nolle prossequi e screen out, que constituíram ferramentas fundamentais para o surgimento da barganha. Em seguida, faz-se um breve registro da história da plea bargaining, desde a resistência do sistema anglo-saxão em aceitar a confissão, passando pela identificação e pela discussão dos incentivos que atuaram sobre as partes e o juiz, para aceitarem e estimularem a assunção de culpa, por parte do acusado, em troca de benefícios penais. |
| Descricão e Informacões Adicionais(en) | Abstract: This paper studies the concept and origins of plea-bargaining in particular in the United States. First, the article will address the concept of plea bargaining and its various forms, explaining briefly what constitutes the nolle prossequi and screen out institutes, which were key tools for the emergence of the bargain. Then starts a brief account of the history of plea bargaining, since the opposition of the Anglo-Saxon system to accept the confession, through the identification and discussion of incentives that act e don?t he parties and the judge to accept and stimulate the defendant?s guilty plea in exchange of criminal benefits.
