Descricão e Informacões Adicionais | Este artigo objetiva fornecer uma reflexão sobre a evolução do conceito de democracia com vistas a adaptá-la às questões contemporâneas que levam a uma flexibilização e alargamento no modo como vem sendo tradicionalmente tratada ao longo dos anos. A partir da análise do terrorismo como ameaça ao direito internacional e dos conceitos de Constituição de Emergência de Bruce Ackerman, com o contraponto de Laurence H. Tribe e Patrick Gudridge adentra-se na questão principal que é como os Estados Unidos tem executado politicas de efetivas de combate ao terrorismo. Com enfoque especifico nos ataques de 11 de setembro de 2001; ponto de partida para algumas legislações internas restritivas quanto aos direitos humanos e exercício de liberdades civis constitucionalmente garantidas, e sob pleno gozo pela população. Dada à relevância externa americana em termos políticos e culturais, é sobremaneira relevante identificar se eles estariam ou não vivendo sob o manto de um estado de exceção no sentido de que estão experimentando momentos em que o governo apresenta características não democráticas, uma vez que a democracia revela-se como a base fundante da sociedade norte-americana. |
Descricão e Informacões Adicionais(en) | This article aims to provide a reflection on the evolution of the concept of democracy with a view to adapt it to contemporary issues that lead to flexibility and broadening the way it has traditionally been seen over the years. From the analysis of terrorism as a threat to international law and the Constitution of Emergency concept of Bruce Ackerman, with the counterpoint of Laurence H. Tribe and Patrick Gudridge, is entered on the main question on how the United States has seen the fight of terrorism, especially after the 11 September 2001 attacks; starting point for some very restrictive domestic legislation regarding human rights and the exercise of constitutionally guaranteed civil liberties and under full enjoyment by the public. Given the American political and cultural foreign relevance, it is exceedingly important to identify whether they were or not living under the guise of a state of exception in the sense that they are experiencing times that the government has no democratic characteristics, while it has democracy by founding base of US society. |
