Descricão e Informacões Adicionais | PAGAMENTO DE PARCELAS IRRISÓRIAS NO PAES (LEI Nº 10.684, DE 2003) E SUAS CONSEQUÊNCIAS JURÍDICAS A Lei nº 10.684, de 30 de maio de 2003, instituiu um programa de parcelamento de dívidas tributárias (PAES), na esfera federal, para débitos mantidos perante a Secretaria da Receita Federal do Brasil ou a Procuradoria-Geral da Fazenda Nacional. Alguns contribuintes, com base em interpretação do § 4º do art. 1º da Lei nº 10.684, de 2003, entenderam que poderiam pagar valores mensais irrisórios, mesmo que isso não significasse a amortização do saldo devedor da dívida. Esse contexto conduziu a um cenário no qual o parcelamento teria duração superior ao prazo máximo de cento e oitenta meses, estipulado no art. 1º da Lei nº 10.684, de 2003. O propósito do presente artigo é analisar as consequências jurídicas dessa situação, levando em consideração a legislação e o entendimento firmado pelo Superior Tributal de Justiça sobre o tema. Descricão e Informacões Adicionais(en) | Abstract Federal Law nº 10,684/2003, instituted an installment program for tax debts (PAES) held before the Federal Revenue Secretariat of Brazil or the Attorney-General´s Office for the National Treasury. Some taxpayers, based on an interpretation of § 4 of art. 1 of the Federal Law nº 10,684/ 2003, convinced themselves that they could pay monthly paltry values, regardless of the amortization of debit. This context has led to a scenario in which the installment would last longer than the maximum term of one hundred and eighty months stipulated in art. 1 of the Federal Law nº 10,684/2003. The purpose of this paper is to analyze the legal consequences of this situation, taking into consideration the Brazilian law and the jurisprudence established by the Superior Court of Justice on that subject.
