Descricão e Informacões Adicionais | RESUMO O treaty shopping, consiste em instrumento de planejamento tributário internacional abusivo utilizado por empresas transnacionais mediante a instalação de uma empresa do grupo ou mesmo filial, sucursal, ou estabelecimento permanente, cujo propósito seria enquadrar-se no conceito de residente para usufruir dos benefícios tributários oriundos de determinado tratado internacional firmado com a finalidade de evitar a dupla tributação da renda. Nesse contexto, a presente pesquisa analisou as medidas de prevenção ao treaty shopping recomendadas pela OCDE, passando pela análise do ordenamento jurídico-tributário brasileiro, especificamente em relação ao princípio da estrita legalidade ou tipicidade cerrada, inexistência de norma geral antielisiva, conflitos legais entre tratados e normas internas, supremacia dos tratados em matéria tributária e institutos do direito civil utilizados no combate à evasão fiscal, a fim de, a partir da análise dos argumentos desenvolvidos, chegar a uma conclusão sobre a viabilidade jurídica de as autoridades fiscais brasileiras aplicarem as cláusulas de teste do propósito principal (Principal Purpose Test - PPT), pautadas em testes da substância econômica dos negócios internacionais, no intuito de prevenir a prática do treaty shopping por meio dos tratados sobre dupla tributação firmados pelo Brasil. Descricão e Informacões Adicionais(en) | ABSTRACT The treaty shopping consists in a abusive international tax planning tool used by transnational companies by installing a group company or subsidiary, branch or permanent establishment, the purpose of which would fall within the concept of resident to take advantage of tax benefits arising of certain international treaty signed in order to avoid double taxation of income. In this context, the present search examined the measures of prevention treaty shopping recommended by the OECD, through the analysis of the Brazilian tax legislation, specifically in relation to the principle of strict legality or closed typicality, lack of general anti-avoidance rules, legal conflicts between treaties and internal rules, supremacy of tax treaties and institutes of civil law used to combat tax evasion, in order, from the analysis of the arguments put forward to reach a conclusion on the legal feasibility of the Brazilian tax authorities apply the provisions of the main purpose test (PPT), guided by a test of the economic substance of international business, in order to prevent the practice of treaty shopping through the double tax treaties signed by Brazil.
