Descricão e Informacões Adicionais | Resumo: O dever fundamental de pagar tributos, inerente a todos os indivíduos de uma sociedade, existe como contraprestação à garantia estatal de criação de estrutura mínima para proporcionar vida digna na coletividade. Desse modo, o tributo possui uma função social a ser cumprida. A despeito da importância do pagamento dos tributos, os indivíduos buscam meios para se eximir da obrigação tributária. Nesse contexto, o trabalho pretendeu demonstrar, a partir de um estudo comparado entre os principais sistemas jurídicos, anglo-saxônico e romanogermânico, as medidas de combate à elisão fiscal, como limites ao planejamento tributário. Concluiu-se que as medidas antielisivas são de primordial importância para a saúde financeira do Fisco e, consequentemente, para o bem-estar da coletividade, pois é por meio do recolhimento dos tributos que o Estado financia a prestação dos serviços públicos essenciais. |
Descricão e Informacões Adicionais(en) | Abstract: The fundamental duty to pay taxes, inherent in all the individuals of a society, exists as consideration for the state guarantee of minimum structure to provide a dignified life in the community. In this way, the tribute has a social function to be fulfilled. Despite the importance of the payment of taxes, individuals seek means to exempt themselves from the tax obligation. In this context, the paper aimed to demonstrate, from a comparative study between the main legal systems, Anglo-Saxon and Roman-Germanic, measures to combat tax avoidance, as limits to tax planning.
