| Descricão e Informacões Adicionais | RESUMO: Este artigo analisa a formação do common law no Direito inglês e no Direito dos EUA, ressaltando os aspectos históricos que permitiram seu desenvolvimento. A seguir, trata do surgimento do fenômeno do positivismo jurídico e de sua relação com o jusnaturalismo. Mostra-se, a seguir, o trabalho de John Austin, com ênfase no que o autor considerava essencial em uma Teoria Geral do Direito, bem como de suas críticas ao common law de sua época. Conclui-se que a common law passou por profundas mudanças ao longo do tempo e que o sistema é expressão de Direito Positivo. Palavra-chave: Filosofia do Direito. Common Law. John Austin. | Descricão e Informacões Adicionais(en) | ABSTRACT: This article analyzes the formation of common law in English and US law, highlighting the historical aspects that allowed its development. Next, it deals with the development of the positivism and its relationship with jusnaturalism. Following, it is presented the work of John Austin, with emphasis on what the author considered essential in a Jurisprudence, as well as his critiques of the common law.
