Descricão e Informacões Adicionais	RESUMO A devolução da Medida Provisória 669/2015 passou a compor o reduzido rol de casos em que Poder Legislativo devolve ao Poder Executivo proposição de sua iniciativa por desatendimento de pressupostos constitucionais, este artigo estuda a devolução feita pelo Presidente da Mesa Diretora do Congresso Nacional a partir da análise das possíveis formas de exercício do controle de constitucionalidade pelo Poder Legislativo, do estudo dos requisitos constitucionais para edição de medidas provisórias, em especial as tributárias, e da verificação do arcabouço normativo que determina o rito de tramitação do instrumento legislativo, e conclui que a devolução monocrática feita pelo Presidente da Mesa Diretora do Congresso Nacional não possui amparo constitucional e previsão regimental. Descricão e Informacões Adicionais(en)	ABSTRACT The devolution of the Provisory Measure 669/2015 to the Executive Power became part of the small list of cases in which the Legislative Power sends back to the Executive Power a proposition of provisional measure that fails constitutional conditions. This article studies this devolution made by the President of the Directorate Board the National Congress departing from the analysis of the possible forms to controlling the constitutionality of the proposal by the Legislative Power, the study of constitutional requirements for issuance of provisional measures, and, particularly, the tax related ones; it also verifies the legal framework that establishes the regimental procedure for this legislative instrument, and comes to the conclusion that a monocratic decision taken by the President of the Directorate Board the National Congress returning the provisional measure has no constitutional grounds and lacks protection under the regimental procedure of the National Congress..
